Terms of Service

Last updated: October 27, 2026

These Terms of Service ("Terms") are a binding agreement between you and Gochcar ("Gochcar", "we", "us"). They apply to the Gochcar website, Portal and mobile apps (the "Platform"). By creating an account or using the Platform you accept these Terms. Please read them, especially Section 14 (arbitration and class-action waiver).

1. What Gochcar is

Gochcar is a technology platform that connects riders with independent drivers. Gochcar does not provide transportation services, is not a transportation carrier and does not employ drivers. The transportation is provided by independent drivers who are solely responsible for it.

2. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to create an account. One account per person; you may not share it or let anyone else use it. Give accurate information and keep it up to date. You are responsible for everything that happens under your account, so keep your password and verification codes private.

We recommend turning on two-step verification in your profile. Minors may not ride alone; a rider must be 18 or older unless the law allows otherwise.

3. Requesting and taking rides

When you request a ride, nearby drivers may accept it. We show you an upfront fare estimate before you confirm. Only you and the guests you tell the driver about may ride. Everyone must wear a seat belt, and you are responsible for a child seat where the law requires one. Please follow the Community Guidelines.

4. Fares, fees and payment

The fare is made up of a base fare, distance, time and a service fee, with a minimum fare per ride type. Tolls, surcharges required by law, promotions and tips may also apply. The itemised fare is shown in the app and on each trip receipt.

You may pay with cash, your Gochcar wallet or another method we offer. You authorise us and our payment partners to charge the payment method you choose. Wallet top-ups are processed by third-party providers such as Stripe or PayPal; Gochcar does not see your full card number. If you change the drop-off during a trip, the fare is recalculated.

5. Cancellations and refunds

You can cancel a ride for free while we are still finding a driver. After a driver has been on the way for more than a short grace period or has arrived, a cancellation fee may apply to compensate the driver; it is shown in the app. See the Refund Policy for how to ask for a review of a charge.

6. Promotions and referrals

Promo codes and credits have the conditions shown with them (minimum fare, expiry date, limit per rider). We may change or end promotions, and we may cancel credits obtained by fraud or misuse.

7. Communications

By giving us your email and mobile number you agree that we may contact you by email, push notification, in-app message and text message about your account, trips, safety and security codes. Message and data rates may apply. Marketing messages are optional and you can opt out at any time in the app settings or by replying STOP to a text message.

8. What you must not do

  • Discriminate against or harass drivers or riders, or refuse a rider because of a service animal or disability.
  • Use the Platform for anything unlawful, fraudulent or unsafe, or to carry weapons, illegal drugs or open alcohol containers.
  • Damage a vehicle, or leave it dirty; the person responsible pays for repair and cleaning.
  • Arrange rides or payments outside the Platform with people you met through it, create fake or duplicate accounts, or manipulate trips, ratings or promotions.
  • Copy, scrape, reverse engineer or interfere with the Platform.

9. Safety and insurance

The Platform offers safety tools such as trip sharing and an SOS button, but in an emergency call local emergency services (911) first. Drivers must carry the personal auto insurance required by their state. Depending on the state and the status of the trip, additional liability coverage may apply as described in the state disclosures we publish. Gochcar does not guarantee the conduct of drivers or riders.

10. Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent permitted by law we do not promise that it will be uninterrupted or error free, and we are not responsible for the acts or omissions of independent drivers, riders or other third parties.

11. Limitation of liability

To the fullest extent permitted by law, Gochcar is not liable for indirect, incidental, special or consequential damages, or lost profits, and its total liability for any claim is limited to the greater of the amount you paid in the three months before the claim or $100. Nothing here limits liability that cannot be limited by law.

12. Indemnity

You agree to defend and reimburse Gochcar for claims, losses and costs caused by your breach of these Terms or misuse of the Platform, to the extent the law allows.

13. Suspension and termination

You can stop using Gochcar and ask us to delete your account at any time from your profile or by contacting support. We may suspend or end your access if you break these Terms or the Community Guidelines, if we suspect fraud or a safety risk, or if the law requires it. Serious conduct (violence, discrimination, sexual misconduct, fraud) can lead to immediate removal. We may keep some information as the law requires.

14. Arbitration and class-action waiver

Please read this carefully: it affects your legal rights. You and Gochcar agree to resolve any dispute through individual, binding arbitration administered by the American Arbitration Association under its consumer rules, instead of a court, except that either of us may bring an individual claim in small-claims court and either of us may seek court relief for infringement of intellectual property. You and Gochcar waive any right to a jury trial and to bring or join class, collective or representative actions. Gochcar pays the arbitration filing and administration fees it is required to pay under those rules.

You may opt out of arbitration within 30 days of creating your account by emailing legal@gochcar.com with your name, the email on your account and the words "opt out of arbitration". If you opt out, disputes go to the courts described in Section 15.

15. Governing law and courts

These Terms are governed by the laws of the State of New York and the Federal Arbitration Act. Claims that are not arbitrated must be brought in the state or federal courts located in New York County, New York, and you consent to that jurisdiction.

16. Changes and contact

We may update these Terms; when we make important changes we will tell you in the app or by email, and using the Platform after the change means you accept it. Questions: support@gochcar.com. Notices of legal claims: legal@gochcar.com.
