These Driver Terms apply in addition to the Terms of Service to anyone who applies to drive or drives with Gochcar ("Driver"). By submitting an application or going online you accept them.
1. Independent business
You are an independent contractor, not an employee, agent or partner of Gochcar. You decide whether, when and where to drive, you may decline requests, and you may use other platforms. You are responsible for your own taxes (Gochcar reports your earnings as the law requires), your vehicle costs and your business expenses.
2. Requirements
- Be at least 21 years old and legally allowed to work in the United States.
- Hold a valid driver license for the state where you drive and keep it from expiring.
- Drive a vehicle that meets our age, seat and condition standards, is registered in a US state and is covered by the personal auto insurance your state requires, with the registration and insurance documents current.
- Provide truthful information and the documents we ask for: license (front and back), a profile photo of your face, registration and insurance with their expiry dates. We may ask you to verify your identity again, for example with a new photo.
- Pass the driving-record and criminal-history screening described in Section 3 and any city or state requirements.
3. Background check and consumer reports
To approve and keep your account we obtain consumer reports, including your motor vehicle record and criminal history, from a screening provider, in line with the Fair Credit Reporting Act and applicable state laws. By applying you authorise this, and we will give you the notices and copies the law requires. If we plan to take an adverse action based on a report, we will tell you first, give you a copy of the report and a chance to dispute it. We never ask for your Social Security number inside the app; the screening provider collects it directly.
4. Fares, commission and payouts
Rider fares are calculated by the Platform. Gochcar keeps a service commission, shown in your earnings, and the rest is your earning. For cash trips you collect the fare and the commission is deducted from your wallet; for wallet trips your earnings are added to your wallet. You can request a payout of your available balance, which we review and send to the account you give us. Tips are yours. Cancellation fees paid by riders are shared with you after commission.
5. Driving safely and treating people well
- Follow traffic laws, never drive impaired or distracted, and keep your vehicle safe and clean. Do not carry more passengers than seat belts.
- Do not discriminate. You may not refuse or treat a rider differently because of race, color, religion, national origin, sex, gender identity, sexual orientation, age, disability or another protected trait, or avoid neighborhoods based on who lives there.
- You must accept riders with service animals and help stow wheelchairs, walkers and similar devices. Allergies, fear or religious objections are not reasons to refuse. Riders with service animals are not charged cleaning fees for hair.
- No weapons, drugs or open alcohol in the vehicle, no harassment or inappropriate contact, and no contact with a rider after the trip except to return a lost item.
- Do not accept rides or payments outside the Platform from riders you met through it.
6. Deactivation
We may suspend or deactivate your account for safety concerns, expired or missing documents, a failed screening, repeated cancellations, low ratings, fraud, discrimination or breaking these terms. While we investigate we may put your account on hold. Where the cause can be fixed (for example an expired document) we will tell you what is needed so you can fix it and come back. You can ask for a review by contacting support.
7. Your information and the Platform
We use your location while you are online to match you with riders, and during trips to guide and protect you and the rider. Our Privacy Policy explains how data is used and kept. Do not share your account or your login.
8. Disputes
Section 14 (arbitration and class-action waiver) and Section 15 (governing law) of the Terms of Service apply to these Driver Terms. Drivers may opt out of arbitration within 30 days of accepting these Driver Terms by emailing legal@gochcar.com.
